Collection and storage of personal data and the type and purpose of their use
When visiting our website www.legerwall.de, the browser installed on your device automatically sends information to our website’s server. As lawyers, civil law notaries and tax consultants, we are bound by a statutory duty of confidentiality. This also applies to all of our employees and delegates. Your data may, therefore, only be transferred by us if and to the extent we are obliged to do so in individual cases, for example due to existing notification requirements vis-à-vis the tax authorities or public registers and courts. In the context of professional and business supervision, we may also be obliged to provide information to the bar, notary chamber or tax advisor chamber and/or supervising authorities, which in turn are also subject to a statutory duty of confidentiality. Otherwise, we will only transfer your data if and to the extent this is necessary according to the GDPR for the processing of engagements with you or in case you have requested the transfer.
In particular, your personal data will only be transferred to third parties if
- you have explicitly consented in accordance with Art. 6 para. 1 clause 1 a) GDPR;
- the disclosure according to Art. 6 para. 1 s. 1 f) GDPR is necessary for the establishment, exercise or defense of legal claims and there is no reason to assume that you have a superseding legitimate interest in not disclosing your data;
- in the event that there is a legal obligation for the transfer according to Art. 6 para. 1 clause 1 GDPR; and
- this is legally permissible and required for performing our services arising out of contractual relationships with you in accordance with Art. 6 para. 1 s. 1 b) GDPR.
Your rights as a data subject
The applicable data protection law grants natural persons comprehensive rights regarding the processing of your personal data (right to information and intervention).
You are entitled
- to request information on your personal data processed by us according to Art. 15 GDPR. In particular, you may request information on the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to correction, deletion, restriction of processing or opposition, the existence of a right to file a complaint, the origin of your data, unless it was collected by us, and the existence of automated decision-making, including profiling and, if necessary, meaningful information on its details;
- to request the correction of incorrect or incomplete personal data stored by us without delay pursuant to Art. 16 GDPR;
- according to Art. 17 GDPR, to request the deletion of your personal data stored by us, unless the processing is required for exercising the right to freedom of expression and information, for fulfilling a legal obligation, for reasons of public interest or for asserting, exercising or defending legal claims;
- to demand restriction of the processing of your personal data according to Art. 18 GDPR, provided that the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to delete it and we no longer require the data, but you need it for the establishment, exercise or defense of legal claims or you have objected to the processing in accordance with Art. 21 GDPR;
- in accordance with Art. 20 GDPR, to receive your personal data provided to us in a structured, common and machine-readable format or to request transmission to another person responsible;
- to revoke your consent granted to us pursuant to Art. 7 para. 3 GDPR at any time. As a result, we must no longer continue the data processing based on this – revoked – consent and you are entitled to complain to a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can address the supervisory authority competent for our Berlin office or, if you have a usual residence in Germany, such supervisory authority;
- according to Art. 21 GDPR, in the event that your personal data is processed on the basis of legitimate interests in accordance with Art. 6 para. 1 s. 1 f) GDPR, you have the right to object to such processing of your personal data, if there are reasons therefor arising from your particular situation or you object to direct advertising. In the latter case, you have a general right to object, which we will honor without requiring you to specify reasons arising from your particular situation.
